Terms of Service
These Terms govern RealVideoCreator and related services provided by Real Labs Development ("RealLabs," "we," "us"). By creating an account, using the service, or starting a paid checkout, you agree to these Terms and acknowledge the Privacy Policy.
1. Eligibility and accounts
You must be legally able to enter a binding contract. You are responsible for accurate account information, safeguarding credentials, and activity under your account. Do not share credentials or bypass account, credit, entitlement, or security controls.
2. The service
RealVideoCreator provides browser-based project tools, AI-assisted video and voice generation, editing, export, protected downloads, and related account and billing features. Features, models, queues, limits, and supported providers may change as the service evolves. We will not materially reduce an already-paid entitlement during its paid period without an appropriate remedy where required.
3. Subscriptions and automatic renewal
Paid plans are monthly subscriptions processed by PayPal. The checkout identifies the plan, monthly price, currency, included credits and limits. By confirming checkout, you authorize recurring monthly charges at the displayed price until canceled.
Monthly credits refresh only after verified payment. Unused monthly credits may expire at the end of the applicable billing period. Purchased token-pack credits are tracked separately.
You may cancel from the billing portal. Cancellation stops future renewals after PayPal processes the request. Access generally continues through the already-paid period when applicable. A cancellation does not automatically refund charges already completed.
4. Plan changes and immediate upgrades
An immediate upgrade can require two PayPal approvals: one for the new recurring plan and one for a displayed prorated charge covering the remainder of the current period. The confirmation page shows the one-time charge and the future monthly renewal price. Higher-tier access is granted only after verified capture.
5. Token packs and credits
Token packs are one-time purchases of service credits. Credits are not money, stored value, cryptocurrency, or property; they have no cash value and are not transferable. Purchased credits currently remain available until used, except when removed after a refund, reversal, chargeback, fraud, account termination for cause, or as required by law.
6. Refunds, reversals, and disputes
If PayPal captures a token-pack or immediate-upgrade payment but local verification or activation fails, the service is designed to request a full refund automatically. Provider processing times apply.
Other refund requests are reviewed based on the transaction, service delivery, usage, applicable law, and PayPal rules. We do not waive rights that cannot legally be waived, and PayPal purchase-protection or dispute rights may apply independently. Refunded or reversed credits and access may be removed; an account may show an unrecovered balance when refunded credits were already consumed.
7. User content and permissions
You retain ownership of content you provide. You grant us a limited, non-exclusive license to host, copy, process, transform, and transmit that content only as needed to operate, secure, and support the service. You represent that you have all rights, permissions, releases, and consents needed for prompts, media, music, likenesses, voices, brands, and other content you submit.
Voice cloning or synthesis may be used only for your own voice or with the informed authorization of the person whose voice is used. You may not impersonate, deceive, harass, defraud, exploit, or violate another person's rights.
8. Prohibited use
You may not use the service to:
- Break law, infringe rights, or create unlawful or deceptive content.
- Distribute malware, interfere with systems, or evade safety controls.
- Probe, scrape, reverse engineer, or overload the service except where law expressly permits.
- Resell accounts, credits, or access without written authorization.
- Use generated content as a substitute for professional legal, medical, financial, or safety advice.
9. Third-party services and personal API keys
PayPal, AI providers, Google authentication, and other connected services operate under their own terms and privacy policies. You are responsible for charges and compliance associated with a personal API key. We are not responsible for a third party's independent service, outage, model behavior, or policy.
10. Availability and generated output
AI output may be inaccurate, incomplete, non-unique, or unsuitable for a particular purpose. You must review outputs and clear all necessary rights before publishing or commercial use. We may maintain, update, suspend, or discontinue features for security, legal, technical, or business reasons.
11. Intellectual property
The service, software, branding, interface, and documentation are owned by RealLabs or its licensors. These Terms do not grant ownership of the service. Protected installers and other licensed downloads may be used only within the license displayed at purchase or delivery.
12. Suspension and termination
We may restrict or terminate access for nonpayment, fraud, abuse, security risk, unlawful use, or material breach. We will use reasonable efforts to provide notice when appropriate. Terms that by nature should survive termination—including payment, records, ownership, disclaimers, and liability provisions—continue to apply.
13. Disclaimers
To the extent permitted by law, the service is provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded.
14. Limitation of liability
To the extent permitted by law, RealLabs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity. Our aggregate liability arising from the service will not exceed the greater of the amount you paid us for the affected service during the six months before the event or USD $100. These limits do not apply where prohibited by law.
15. Governing law and disputes
These Terms are governed by the laws of Michigan, without regard to conflict-of-law rules, except where mandatory consumer law provides otherwise. Before filing a claim, contact us and allow a reasonable opportunity to resolve the issue informally.
16. Changes
We may update these Terms prospectively. We will post the new version and effective date and provide additional notice for material changes when required. A new paid checkout requires acceptance of the then-current version.
